Estate Planning for Midwest Families
A complete, properly funded estate plan protects your family, preserves what you've built, and makes sure the right people get the right things without the mess.
Most Families PUT ESTATE PLANNING OFF.
HERE'S WHAT THAT COSTS.
Only 24% of American adults have an estate plan in place. The rest intend to get it done, but the topic feels overwhelming, the advice is conflicting, and life keeps getting in the way.
When someone dies without a plan, the consequences are predictable: assets tied up in probate, family members left guessing, relationships strained by conflict that could have been avoided. The mess doesn't have to happen. It's entirely preventable with the right plan in place.
At Generations Law Firm, we've spent years helping Midwest families get this done. Not just drafted, but fully implemented and properly funded, so your plan actually works when your family needs it most.
What does a complete estate plan actually include?
A well-designed estate plan is more than a will. It's a coordinated set of legal documents and funding instructions that work together to protect your assets, your healthcare decisions, and your family's future.
Trust
A trust is one of the most flexible tools in estate planning. A revocable living trust allows you to control your assets during your lifetime and distribute them after your death without probate. Depending on your goals, other structures may also play a role, including special needs trusts, charitable trusts, and irrevocable trusts for specific tax or asset protection purposes.
Will
A will directs how your assets are distributed after your death and allows you to name guardians for minor children. Even clients with a trust in place benefit from having a will as a safety net for any assets that were not transferred into the trust before death.
Charitable Giving
For clients who want their generosity to outlast them, we integrate charitable goals directly into the estate plan. Whether through a bequest, a donor-advised fund, or a charitable trust, we make sure your giving is structured to maximize both its impact and its tax efficiency.
Trust Funding
A trust that is not funded is a trust that does not work. Funding means making sure your accounts, real estate, and other assets are properly coordinated with your trust. We provide you with a personalized Trust Funding Blueprint that outlines your assets and gives you clear instructions for funding each one, so you know exactly what steps to take.
Power of Attorney
A durable power of attorney designates a trusted person to manage your financial affairs if you become incapacitated. Without one, your family may need court intervention to access accounts, pay bills, or make financial decisions on your behalf during an already difficult time.
Healthcare Directive
A healthcare directive documents your medical care preferences and designates someone to make healthcare decisions for you if you cannot speak for yourself. It removes an enormous burden from your family and ensures your wishes are known and honored when it matters most.

YOUR PLAN TOUCHES MORE THAN THE LAW.
A GOOD ESTATE PLAN DOESN'T EXIST IN ISOLATION.
A good estate plan sits at the intersection of three things: what you own and how it is titled, what you owe in taxes now and later, and what your legal documents actually say. When those three pieces are out of sync, families run into the same problems again and again: an account that never got retitled to the trust, a beneficiary form that contradicts the will, a gifting strategy that made sense financially but created an unexpected tax bill.
We call this the alignment triangle, and it is why we do not draft your plan in a vacuum. We coordinate directly with your financial advisor and your tax professional so that your accounts, your tax strategy, and your legal documents are all telling the same story. When one piece changes, the others need to change with it, and that only happens with real communication between the people managing each part of your plan.
Where it makes sense, we will reach out to your existing advisors directly. If you do not have a financial advisor or CPA yet, we can help you find one who fits your situation.

ESTATE PLANNING FOR YOUNG FAMILIES
If you have children, you need a plan.
Most young families put estate planning off because it feels like something for later, when there is more to protect or more time to think about it. But the most important reason to have a plan in place has nothing to do with assets. It is about making sure the people who depend on you are protected if something happens to you before you are ready.
A complete estate plan for a young family answers the questions that matter most: Who will raise your children if you cannot? Who will manage their inheritance until they are old enough to do so themselves? What happens to your home, your accounts, and your life insurance if both parents are gone? Without a plan, those decisions are left to a court.
Generations Law Firm works with young families across the Midwest to put straightforward, properly funded plans in place, so you can stop carrying that weight and get back to the things that actually matter.
KEEPING YOUR PLAN CURRENT
Your life changes. Your estate plan should too.
An estate plan is not a one-and-done document. The plan you put in place five years ago may not reflect your family, your assets, or your wishes today. We recommend reviewing your plan any time a major life event occurs, and at a minimum every three to five years.
YOU MAY NEED TO UPDATE YOUR ESTATE PLAN IF:
You have gotten married or divorced
You have had or adopted a child or grandchild
A beneficiary or trusted person named in your plan has died
You have purchased, sold, or inherited real estate
Your assets or net worth have changed significantly
You have started, sold, or dissolved a business
You have moved to a new state
A named guardian, trustee, or personal representative is no longer the right choice
Your charitable giving goals have changed
A family member has developed a serious illness or disability
Federal or state tax laws have changed in a way that affects your plan
You simply have not looked at your plan in the last five years

ESTATE PLANNING QUESTIONS
WE GET ASKED ALL THE TIME
Do I need a trust or a will?
Both serve important purposes, and many families benefit from having both. A will is essential for naming guardians for minor children and directing final asset distribution. A revocable living trust offers greater control, privacy, and, when properly funded, allows your family to avoid probate entirely. At Generations Law Firm, we'll help you understand which structure makes the most sense for your specific situation.
What happens if I die without an estate plan in Minnesota?
If you die without a will or trust in Minnesota, your assets are distributed according to state intestacy laws, which may not reflect your wishes. The probate process can be lengthy, costly, and public. Family members may face conflict, delays, and unnecessary legal fees. A properly designed estate plan eliminates most of these risks.
How long does the estate planning process take?
For most families, the process from initial consultation to signed documents takes 45 to 60 days. The timeline depends on the complexity of your plan and how quickly we're able to gather the information we need. Our team is designed to keep things moving, you'll always know where your file stands.
What is trust funding and why does it matter?
Trust funding is the process of making sure your assets are properly coordinated with your trust, including retitling accounts, updating beneficiary designations, and transferring real estate where appropriate. A trust that isn’t properly funded may not work as intended and could still leave assets subject to probate. We provide you with clear, asset-by-asset guidance so you know exactly what steps to take to complete the funding process.
Do I need to update my estate plan if I already have one?
Yes, estate plans should be reviewed any time you experience a major life change: marriage, divorce, the birth of a child, the death of a beneficiary, a significant change in assets, or a move to a new state. We also recommend a general review every three to five years, even without a major life event, to account for changes in tax law and estate planning best practices.
